CJI-designate Chandrachud part of landmark verdicts: A few highlights

He is no stranger to the hallowed corridors of the Supreme Court over which his illustrious father presided for about seven years and four months, the longest in the institution's history. Dhananjaya Y Chandrachud, however, had no qualms about overturning the judgements of father Y V Chandrachud on hot- button issues like adultery and the right to privacy. The senior-most Supreme Court judge will now take over as the 50th Chief Justice of India on November 9, stepping into the shoes of his redoubtable father Y V Chandrachud, who was the CJI between 1978 and 1985, the first instance of a father-son duo occupying the most sanctified seat in the over seven-decade history of the highest court of India. The formidable DY Chandrachud, has been part of several constitution benches and penned landmark verdicts at the top court, including those in the vexed Ayodhya land title dispute. Justice Chandrachud will take the charge from incumbent CJI Uday Umesh Lalit, who recommended him as his .

Justice Hemant Gupta has always been great asset to institution: CJI Lalit

Chief Justice of India (CJI) Uday Umesh Lalit on Friday said Supreme Court judge Justice Hemant Gupta, who is set to retire on October 16, has always been a "great asset" to the institution. The CJI, who was heading the bench which also comprised Justice Gupta, said the latter has always tried to contribute to whatever he was called upon to decide to the best of his ability. "He is always a great asset to the institution and we wish him all good health, good luck and everything what he deserves and aspires for," Justice Lalit said. Justice Gupta, who was elevated as an apex court judge on November 2, 2018, said it was a "personally enriching experience" to be in the top court and he always got assistance from all lawyers. "Personally speaking, I enjoyed my innings of judgeship of about 20 years. Each day was learning experience and all of you have helped me in my learning process. Thank you very much," Justice Gupta told the advocates, who were present in the court to bid him ...

CJI Lalit says lawyers must be rational in thinking, fact-finding in nature

Lawyers must be rational in thinking and fact-finding in nature, Chief Justice of India Uday Umesh Lalit said on Saturday. Addressing a seminar organised by the Bar Council of India in Patna, CJI Lalit said the objective of advocates should be upholding the rule of law. "Lawyers must keep in mind that their objective and motto should be upholding the rule of law. Advocates have a wonderful quality of convincing and catering fundamental inputs to the mind of the public. They must be rational in thinking and fact-finding in nature," he said. Young lawyers should draw inspiration from the inherent qualities of eminent freedom fighters who were lawyers, he said. "Even many freedom fighters were from the legal profession. Young lawyers have a bigger role to play in society," CJI Lalit added. Union Minister for Law and Justice Kiren Rijiju, who also addressed the gathering, said the executive, legislature and judiciary are working in the interests of the nation. "All three pillars shou

Half of judiciary's problems due to state-sponsored litigation: NV Ramana

Former Chief Justice of India, NV Ramana on Saturday termed the government as the 'biggest litigator' and said half of the judiciary's problems will be resolved if it decides to put a halt to the state-sponsored litigations. Speaking at ISB Leadership Summit 2022, he rued that the state of judicial infrastructure in this country even after 75 years of independence was 'disturbing' and a nationwide study that he had commissioned revealed certain hard truths about the poor state of judicial infrastructure in this country. During the chief ministers and chief justices conference last April, I had the occasion to highlight my understanding of these problems. As I told in the presence of the honourable Prime Minister, one of the major concerns is that the government is the biggest litigator, he recalled. The number of inter-departmental disputes, service matters and those relating to interaction of authorities clogging the system is appalling. Half of the judiciary problem would be solve

SC to hear pleas challenging constitutional validity of CAA on Oct 31

The Supreme Court said on Monday it will hear on October 31 a batch of pleas challenging the constitutional validity of the Citizenship (Amendment) Act (CAA) which seeks to grant citizenship to non-Muslim migrants fleeing religious persecution in Pakistan, Bangladesh and Afghanistan who entered India on or before December 31, 2014. A bench comprising Chief Justice U U Lalit and Justice S R Bhat noted the matter will be referred to a three-judge bench. The 2019 amended law, which seeks to grant Indian citizenship to non-Muslim migrants belonging to Hindu, Sikh, Buddhist, Christian, Jain, and Parsi communities from Pakistan, Bangladesh and Afghanistan has come in for stinging criticism by opposition parties, leaders and other entities over exclusion of Muslims. During the hearing on Monday, Solicitor General Tushar Mehta, appearing for the Centre, told the bench that several issues have been raised in the petitions filed before the top court. "Our reply is filed so far as some ...

CJI Ramana retired without constituting bench for Article 370 pleas: Omar

Two days after Chief Justice of India N V Ramana retired, National Conference (NC) vice president Omar Abdullah on Sunday alleged he "very conveniently kicked into the long grass" the petitions against the nullification of Article 370, which accorded special status to Jammu and Kashmir. Abdullah shared a news report on Twitter about CJI Ramana's comments in April this year that the Supreme Court would hear the petitions after the summer vacation, and said, "And then he retired without ever constituting the bench. He very conveniently kicked it into the long grass." "Some people wonder why faith in these institutions gets eroded. Perhaps it has something to do with the way serious issues are handled," the former Jammu and Kashmir chief minister added. The Centre on August 5, 2019 abrogated Article 370 of the Constitution -- which gave special status to Jammu and Kashmir -- and bifurcated the state into Union territories. Several mainstream parties, including Abdullah's NC, challenge

CJI Ramana took historic decisions; appointed of 11 SC, over 220 HC judges

Chief Justice of India N V Ramana took path-breaking judicial and administrative decisions that included putting the sedition law on hold, reviewing the money laundering verdict, ordering probes into Pegasus snooping and Lakhimpur Kheri cases and ensuring appointments of record 11 judges in the top court and over 220 in high courts. On his last day in the office, the 48th CJI got one more feather in his cap by ensuring live streaming of Supreme Court proceedings of the ceremonial bench headed by him by implementing the 2018 verdict which had allowed such webcasts. Hailing from an agriculturist family in Ponnavaram village of Andhra Pradesh's Krishna district, Justice Ramana had succeeded S A Bobde on April 24, 2021 with a dire situation of huge unfilled vacancies in the top court and the high courts staring at the face of the judiciary. The apex court had not got a single judge after the superannuation of the then CJI Ranjan Gogoi on November 17, 2019 and had nine existing vacancies

In a first, Supreme Court to live steam proceeding of CJI's court

For the first time since its inception, the Supreme Court on Friday will live stream proceedings. The proceeding of the bench headed by CJI N V Ramana will be live streamed through a webcast portal. Incumbent Ramana is to demit office Friday. Please take notice that on the eve of laying down the office of the Hon'ble Chief Justice of India, the proceedings of the Hon'ble Chief Justice' Court i.e., Ceremonial Bench on August 26, 2022, 10:30 A.M. onwards shall be lives streamed through the NIC webcast portal," a notice said. Attorney General K K Venugopal had earlier suggested that live streaming of
