Evidence of corruption unearthed at the government's key foodgrain procurement agency raises questions about whether the problem is systemic or a failure of governance

The Bombay High Court on Wednesday granted bail to Sanjeev Palande, former private secretary of NCP leader Anil Deshmukh, in a corruption case being probed by the Central Bureau of Investigation. Former Maharashtra minister Deshmukh, also an accused in the case, is currently out on bail. A single bench of Justice M S Karnik allowed Palande's bail plea after hearing arguments of the both sides. He is likely to walk out of the jail on January 27, his lawyer Shekhar Jagtap said. The HC had last month granted bail to Palande in a money laundering case being probed by the Enforcement Directorate. The ED had arrested Palande in June 2021 in connection with the money laundering case. Later, the CBI took his custody in the corruption case in April 2022. The Supreme Court on Thursday said a public servant can be convicted for illegal gratification in a corruption case on the basis of circumstantial evidence when there is no direct oral or documentary evidence against them. A five-judge Constitution bench headed by Justice S A Nazeer said complainants as well as the prosecution should make sincere efforts so that corrupt public servants are brought to book and convicted so that the administration and governance become unpolluted and free from corruption. "In the absence of evidence of complainant (direct or primary), it is permissible to draw an inferential deduction of culpability," the bench, also comprising justices B R Gavai, A S Bopanna, V Ramasubramanian and B V Nagarathna, said. The Bombay High Court is likely to pass an order on Monday on the bail plea of former Maharashtra home minister Anil Deshmukh in a corruption case being probed by the Central Bureau of Investigation (CBI). A single bench of Justice M S Karnik had reserved the order on the plea last week after both sides completed their arguments. Deshmukh, 74, approached the HC after a special CBI court rejected his bail plea last month. He sought bail on medical grounds as well as on merits. The Nationalist Congress Party (NCP) leader has been in jail since November last year after he was arrested by the Enforcement Directorate (ED) in a money laundering case. The Central Bureau of Investigation (CBI) on Friday filed its reply opposing the bail plea of former Maharashtra home minister Anil Deshmukh in a corruption case registered against him. The 71-year-old NCP leader was arrested in November last year in a money laundering case being probed by the Enforcement Directorate (ED) and is currently lodged in Arthur Road Jail. The Bombay High Court had last week granted bail to the former minister in the money laundering case, following which he approached the special CBI court for bail in the corruption case. The CBI has "examined" former governor Satya Pal Malik in connection with two graft cases registered in Jammu and Kashmir in April based on allegations levelled by him, officials said. They said the CBI team took details of his observations earlier this week, they said. Malik was examined after his five years tenure as Governor ended on October 4, they said.
