Delhi HC rejects Amazon plea alleging dilution of broadcast rights

The Delhi High Court on Friday rejected a petition by Amazon Seller Services Pvt Ltd against the alleged dilution of its exclusive media rights to broadcast the ongoing cricket series between India and New Zealand. Dismissed, said Justice Yashwant Varma who was hearing Amazon's challenge to a TDSAT order which, the petitioner claimed, allowed all private cable and DTH operators to re-transmit the sports content shared by it with Prasar Bharati. The detailed copy of the order is awaited. The petition said, following a plea by a private DTH operator, the Telecom Disputes Settlement and Appellate Tribunal (TDSAT) erringly expanded the scope of the contractual rights granted by the petitioner to Prasar Bharati with respect to broadcasting the cricket series on its channel DD Sports. Delhi High Court grants bail to Rana Kapoor in money laundering case

The Delhi High Court on Friday granted regular bail to former Managing Director and CEO of YES Bank Rana Kapoor in a Rs 466.51 crore money laundering case.The case is being probed by the Enforcement Directorate (ED).The Bench of Justice Sudhir Kumar Jain on Friday granted bail to him.The trial court in October last year, took cognizance of the Enforcement Directorate (ED) Chargesheet (Prosecution Complaint) filed against Avantha group promoter Gautam Thapar involving Yes Bank's Rana Kapoor and several employees in connection with money laundering case.According to the ED, an ECIR was registered against Gautam Thapar, Avantha Realty Ltd., Oyster Buildwell Pvt. Ltd. and others, alleging criminal breach of trust, cheating, criminal conspiracy and forgery for diversion/ misappropriation of public money during the period 2017 to 2019.

HC give 'last indulgence' to ASI to remove Tughlaqabad Fort encroachment

The Delhi High Court Thursday granted six weeks as the last indulgence to the Archaeological Survey of India (ASI) to remove encroachments in and around the Tughlaqabad Fort. A bench of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad made it clear that non-compliance with its order will lead to strict action by the court and that it will call for appearance of members of a committee which was formed in 2017 to oversee the task of surveying the structure to determine which of them existed in 1993. As the counsel for ASI expressed its inability to remove the encroachments due to non-cooperation of other departments, the lawyers for MCD, DDA and other authorities submitted they will extend full assistance to the ASI. ED opposes in Delhi HC plea by D K Shivakumar against probe in PMLA case

The ED on Wednesday opposed in the Delhi High Court a plea by Karnataka Congress chief D K Shivakumar challenging a money laundering probe against him, saying the two ECIRs lodged by the agency pertain to different cases with certain overlapping of facts which cannot be termed a re-investigation. Shivakumar, in his plea, has sought quashing of the entire investigation, including summons issued to him in the (Enforcement Case Information Report) ECIR registered by the ED in 2020, on several grounds like the agency was re-investigating the same offence which it had already probed in a previous case lodged by it in 2018. Delhi govt to pay over Rs 16L to judicial officer for Covid treatment

The Delhi High Court has directed the Delhi government to reimburse forthwith over Rs 16 lakh to a serving judge of the district judiciary towards the cost of Covid treatment incurred by him during the second wave of the pandemic. The high court refused to accept the submission of the Delhi government's counsel that the private hospital, where the Additional District Judge (ADJ) was treated, shall be asked to explain why it charged amounts higher than those prescribed in a government circular. The hospital, he said, shall be directed to refund the overcharged amount of Rs 16,93,880. Justice Rekha Palli said the fact remains that during April-May 2021, when the residents of Delhi were not only struggling to get hospital beds but there was also a huge shortage of oxygen, the petitioner judge had no other option but to seek treatment at a private hospital and has thankfully survived. Delhi HC rejects challenge to CIC order on RTI plea over PM's suit auction

The Delhi High Court on Tuesday rejected a petition challenging a CIC decision refusing to impose penalty on an official for belatedly providing information on an RTI application seeking certain details in relation to the auction of a suit worn by Prime Minister Narendra Modi, calling the plea "misconceived". Justice Yashwant Varma dismissed the petition by the RTI applicant and said no case was established before the Chief Information Commissioner (CIC) to warrant a penalty. The petitioner, who assailed the order passed by the CIC in July 2021, said he had filed an application under the Right to Information Act seeking information pertaining to Modi's suit and its auction but it was given to him after a delay of one year and therefore the CIC should have imposed a penalty on the official concerned. Delhi HC dismisses plea to transfer Shraddha Walkar murder case to CBI

Terming it a 'publicity interest litigation', the Delhi High Court on Tuesday dismissed with costs a PIL seeking directions for the Shraddha Walkar murder investigation to be transferred from Delhi Police to the Central Bureau of Investigation (CBI). The court, however, did not specify the cost amount. A bench of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad said it was a publicity interest litigation and not a single ground was made out. Entitlement to post-retirement benefits is based on the terms of the services and it is open for the Central government to fix a cut-off date for the purposes of changing the conditions relating to payment of pension to its employees, the Delhi High Court said on Monday. The observations came on a batch of petitions by some high court employees challenging a Central government office memorandum (OM) which said that the coverage under the Central Civil Services (Pension) Rules, 1972, i.e. the Old Pension Scheme was confined to only to those candidates who were recruited against vacancies arising on or before December 31, 2003 and the selection results were declared on or before April 1, 2004. The Delhi High Court will hear on Monday a plea by businessman Vijay Nair, an accused in the Delhi excise policy scam case, claiming that sensitive information related to the matter was being leaked to the media by investigating agencies. Late payment rule doesn't apply to pvt unaided institutions in Delhi: HC

The Delhi High Court has said provisions of the Delhi School Education Rules which state a school cannot charge fine in excess of five paise a day for late payment of fees, does not apply to private unaided schools here. The order was passed by a bench of justices Vibhu Bakhru and Amit Mahajan on a petition by the Action Committee Unaided Recognised Private School, an umbrella association of more than 500 private unaided schools in Delhi. The petitioner had assailed a February 2013 order of the Directorate of Education (DoE) holding that in terms of rule 166 under Chapter XIII of of the Rules, a private unaided school here cannot charge any fine in excess of five paise per day on account of late payment of fees by a student. Delhi High Court to hear pleas challenging Agnipath scheme on Dec 12

The Delhi High Court Friday said it will first hear the pleas directly challenging the Centre's Agnipath scheme and then decide those concerning the recruitment processes for the armed forces under certain previous advertisements. A bench of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad said it will hear on December 12 a batch of pleas challenging the scheme. The bench asked Additional Solicitor General Aishwarya Bhati to segregate petitions which are challenging the Agnipath scheme and those concerning the recruitment processes for the armed forces under certain previous advertisements and file a chart before the court. "We will first hear the Agniveer matter. The core issue here is Agniveer. This is our opinion. If this issue is decided this way or that way, it will have some bearing on other cases," the bench said.
