Delhi court dismisses Satyendar Jain's plea seeking special food items

A Delhi court on Saturday dismissed a plea by jailed AAP minister Satyendar Jain seeking direction to Tihar officials to provide him special food items according to his religious beliefs. Special judge Vikas Dhull dismissed the application noting the jail administration's submission that no special facility is provided to any prisoner and Jain was allowed to avail all facilities under law, like other inmates. The application had also sought a direction to the prison officials to immediately conduct the minister's medical check-up. It had alleged that Jain was not being provided basic food and medical facilities inside the prison. The jail administration, however, had opposed the application, saying Jain was allowed to avail all facilities under law, like other prisoners. Jain was arrested in a money laundering case based on a CBI FIR lodged against him in 2017 under the Prevention of Corruption Act. The court had on November 17 refused bail to Jain and two others in the case. He

Courts should be sensitive, we are dealing with humans not files: Delhi HC

Courts need to maintain sensitivity and compassion that is balanced with law as they are dealing with humans and not mere files and orders, the Delhi High Court has said. The court's observation came while dealing with a petition by a murder convict serving a life term, who sought a two-month parole to settle the division of his family property, arrange funds for his family and also "curb inner stress" following the death of his mother. The petitioner's request for parole was turned down by the Delhi government on several grounds, including that his conduct in jail was unsatisfactory. Justice Swarana Kanta Sharma, however, directed the release of the petitioner for a period of 45 days on parole, saying, "Sensitivity and compassion balanced with rules, regulations and law needs to be maintained by any court as one is dealing with humans and not mere files and orders." The judge considered that the petitioner, who has spent 14 years in jail and was earlier granted parole on seven ...

After over 21 years, court acquits 3 in spurious soft drink factory case

More than 21 years after an FIR was registered against three on the charge of criminal conspiracy for running a spurious soft drink factory, a Delhi court has acquitted the trio, saying investigation was not done with the sincerity required. The court also acquitted them of the charge of infringement of copyright, and said the manner in which the prosecution witnesses were examined, seemed it was only paperwork without a specific target in mind. The court was hearing a case against Shankar, Mahesh and Bhupinder Singh, who were arrested for allegedly running a factory where some spurious drink was filled into empty soft drink bottles of Pepsi and Coca Cola in Sudarshan Park area of west Delhi on June 18, 2001. In my opinion, the accused have been able to raise a probable defence creating doubt about the existence or veracity of the prosecution version which renders the same untrustworthy. Accordingly, accused persons are acquitted of the charge levelled against them, Chief Metropolit

Court issues contempt notice to Delhi Police for non-compliance of orders

A court here has issued a contempt notice to the Delhi Police Commissioner in a case of alleged gangrape of a woman and said "the narration and sequence of events in the case depicted a sordid and pathetic state of affairs in the administration of Delhi Police." The court was hearing the bail plea of an accused in the case and noted that an FIR was registered at Sangam Vihar police station almost 36 days after the victim woman filed a complaint before the Station House Officer (SHO). DHFL bank fraud: Court denies bail to businessman in Rs 34,615-crore scam

A Delhi court has denied bail to businessman Ajay Ramesh Nawandar in a Rs 34,615-crore bank fraud case involving Dewan Housing Finance Limited (DHFL), on account of his possible influence on both evidence and witnesses. The court held that the accused was prima facie complicit at some stage in the diversion of the humongous funds originating from the loans. In the present facts, the Court is inclined to decline the bail not because the offences are economic in nature but on account of the investigation into the present offences being intricate, the accused prima facie being complicit at some stage of the handling/diversion of the humongous funds originating from the loans, a strong likelihood of him tampering with evidence and the foreseeable possibility of him influencing witnesses if admitted to bail, Special Judge Vishal Gogne said. The Central Bureau of Investigation (CBI) had earlier conducted searches at Nawandar's premises and recovered a large collection of uber-luxury watch
