Refusing to defreeze the accounts and set aside the show-cause notice issued to a Kerala-based loan app company, the High Court of Karnataka has cautioned against such apps owned by Chinese entities and individuals which are used to destabilise India. In a recent judgment, Justice M Nagaprasanna, while rejecting the petition of Inditrade Fincorp Ltd, registered in Kochi, said, "It is in public domain that several borrowers have committed suicide unable to bear the harassments of the representatives of such loan apps. The office-bearers of several of these companies which control and operate such mobile loan apps are said to be entities of China or individuals from China sitting as directors of such mobile loan apps. Therefore, it becomes necessary for an investigation, in the least to be conducted of any such company who would operate such loan apps and has transactions between each other." The Supreme Court Collegium headed by Chief Justice of India D Y Chandrachud on Wednesday recommended to the Centre the names of 20 additional judges for making them permanent judges in high courts of Allahabad, Mumbai, Madras and Delhi. Of the 20 names, the maximum 10 have been recommended for the Allahabad HC by the three-member Collegium, also comprising justices Sanjay Kishan Kaul and KM Joseph. The Collegiums recommended five for the Madras High Court, four for the Bombay High Court and one for the Delhi High Court. "The Collegium resolves to recommend that S/Shri Justices (1) Chandra Kumar Rai, (2) Krishan Pahal, (3) Sameer Jain, (4) Ashutosh Srivastava, (5) Subhash Vidyarthi, (6) Brij Raj Singh, (7) Shree Prakash Singh, (8) Vikas Budhwar, (9) Om Prakash Tripathi, and (10) Vikram D. The Supreme Court on Monday agreed to hear a plea challenging the appointment of lawyer L Victoria Gowri as a judge of the Madras High Court. A bench comprising Chief Justice DY Chandrachud, and Justices PS Narasimha and JB Pardiwala took note of the submissions of senior advocate Raju Ramachandran that the plea needed urgent hearing. He pleaded it was an urgent petition by senior lawyers of Madras. "They are praying for interim relief. I would request you to take it at the earliest," the senior lawyer said. The bench, which initially agreed to list the plea for hearing on February 13, later said it will hear it on February 10. Amid a renewed attack mounted by the government on the collegium system of appointing members to the higher judiciary, a "record" 138 judges were appointed to the various high courts this year. Law Minister Kiren Rijiju, who has been questioning the collegium system, dubbed it as being "alien" to the Constitution. He also said that the issue of vacancies and appointments in the higher judiciary would continue to linger till such time a new system is created for the same. Seeking to overturn the collegium system, Parliament had passed - with near unanimity - the National Judicial Appointments Commission Act which was given constitutional status. The government brought into force the Constitution (Ninety-Ninth Amendment) Act, 2014 and the National Judicial Appointments Commission Act, 2014 on April 13, 2015. A total of 153 judges have been appointed to the various high courts in this calendar year so far, with sources on Thursday hinting at more appointments to the higher judiciary in the coming days. Six additional judges were appointed to the Bombay High Court on Thursday. It is learnt that the government is also set to take a call on the elevation of Bombay High Court Chief Justice Dipankar Datta to the top court shortly. If he is appointed to the apex court, its working strength will go up to 30. The sanctioned strength of the top court is 34, including the Chief Justice of India (CJI). The government is also set to initiate the process of appointing the next CJI, most likely this week or early next week. Most judges sitting on Australia's highest court will be women for the first time in the institution's 121-year history, the attorney-general said on Thursday. Justice Jayne Jagot will fill a High Court vacancy on its seven-judge bench when Justice Patrick Keane retires Oct. 17, Attorney-General Mark Dreyfus said.
