Samajwadi Party MLA Abdullah Azam Khan was disqualified from the Uttar Pradesh Assembly on Wednesday, an official said, days after a court sentenced him to two-year imprisonment in a 15-year-old case. This is Khan's second disqualification from the Assembly. Khan, the son of senior Samajwadi Party leader Azam Khan, represented Suar in Rampur district in the Assembly. "Abdullah Azam Khan has been disqualified following the Moradabad court order sentencing him to two years (in jail) in a 15-year-old case. His seat has been declared vacant from February 13," a senior official of the Assembly said. Months after Samajwadi Party leader Azam Khan was disqualified from the Uttar Pradesh Legislative Assembly, his son Abdullah Azam Khan possibly faces the same fate after a Moradabad court sentenced him to two years in jail in a 15-year-old case. Assembly officials on Tuesday said they are waiting for the copy of the Moradabad court's judgment and will take a decision on declaring the Swar seat vacant after receiving it. The Representation of the People Act lists offences which can lead to disqualification of legislators, and also states that anyone sentenced to imprisonment of two years or more shall be disqualified "from the date of such conviction" and remain disqualified for another six years after serving time in jail. The Supreme Court on Wednesday directed the Election Commission not to issue till November 10 the notification for the assembly bypoll in Rampur Sadar in Uttar Pradesh, which fell vacant following the disqualification of Samajwadi Party MLA Azam Khan after his conviction in a hate speech case. A bench headed by Chief Justice D Y Chandrachud directed a special sessions court to hear and decide on Thursday itself the appeal of Khan seeking a stay on his conviction so that he survives disqualification as a lawmaker. The Supreme Court said the Election Commission can issue the notification for the bypoll on or after November 11 once the sessions court decides on Khan's plea. On October 27, Khan was convicted in the hate speech case and sent to three years in jail by a Rampur court. The MP-MLA court in Rampur also granted bail to the MLA in the 2019 case. On October 28, the Uttar Pradesh Legislative Assembly Secretariat had announced the disqualification of Khan from the House.

The Uttar Pradesh Legislative Assembly secretariat on Friday announced the disqualification of Samajwadi Party leader Azam Khan from the House, a day after a court sentenced him to three years in jail in a hate speech case. Principal Secretary of the UP Legislative Assembly Pradeep Dubey told PTI that the Assembly Secretariat declared the Rampur Sadar Assembly seat as vacant. "A vacancy has been declared by the UP Vidhan Sabha Secretariat consequent upon the disqualification due to the judgment passed by the court," he said. The Allahabad High Court on Friday dismissed a bunch of pleas seeking quashing of criminal proceedings against Samajwadi Party leader Azam Khan in cases of alleged forcible possession of land for Rampur's Jauhar University.
