Trial in Lakhimpur Kheri violence case not 'slow paced', says Supreme Court

The Supreme Court on Tuesday said the trial in the 2021 Lakhimpur Kheri violence case, in which Union minister Ajay Kumar Mishra's son Ashish is among those facing prosecution, is not "slow paced" and directed the concerned sessions judge to keep apprising it about the future developments of the trial. The top court observed though it is not monitoring the trial but it is having an "indirect supervision" on it. A bench of Justices Surya Kant and J K Maheshwari said the interim direction contained in its January 25 order, by which it had granted eight-week interim bail to Ashish Mishra in the case, shall continue to operate. Advocate Prashant Bhushan, representing the victim families, told the bench that about 200 prosecution witnesses have to be examined and he is concerned about the "slow pace of the trial". Neymar's trial on fraud and corruption concludes, prison sentence reduced

Neymar's trial concluded on Monday with the company that accused him of fraud and corruption reducing the prison sentence it sought for the player's alleged involvement in irregularities related to his transfer from Santos to Barcelona in 2013. The trial's conclusion came three days after Spain's state prosecutor dropped its charges against Neymar, his father and the former executives of the Brazilian and Spanish clubs. Brazilian company DIS continued with its charges but called for a revised prison sentence of two and a half years for Neymar and four years for Neymar's father, who is also the player's agent. DIS initially sought five-year jail terms for the 30-year-old Neymar, his father and former Barcelona executives Sandro Rosell and Josep Bartomeu. DIS also wants compensation of 34 million euros ($33.6 million) and a fine of 195 million euros that would be paid by the accused to the Spanish state. Duty of trial court to ensure that trial is not prolonged, says SC

The Supreme Court has expressed displeasure over the delay in examination of witnesses, and said it is the duty of the trial court to ensure that the trial is not prolonged as time lag creates problems in the testimony of witnesses. A bench of Justices S K Kaul and M M Sundresh said the trial court must control the dilatory tactics of any of the parties. The observations came while granting bail to an man who was accused of facilitating the escape of persons who murdered the Mayor of Chittor district in Andhra Pradesh. The top court noted that the man is in jail since the last seven years and prosecution witnesses are yet to be examined. We are troubled by the fact that seven years after the incident the prosecution witnesses have not been examined and the trial is yet to commence. This is completely unacceptable.
