Visual media has devastating effect, no one has time to read newspapers: SC

The Supreme Court Wednesday said it made reference to TV news channels while hearing pleas related to hate speech because visual media has got a "devastating" effect and nobody cares what is written in newspapers as people are bereft of time to read. A bench of Justices K M Joseph and Hrishikesh Roy refused to implead the Press Council of India and the National Association of Broadcasters as parties to a batch of petitions related to hate speech and rumour-mongering. "We made reference to TV news channels because the hate speech is through the visual medium. If somebody writes something in newspapers, nobody reads it nowadays. Nobody has time to read newspapers. "Visual media has got the power which has been recognised right from cases relating to censorship. The difference between visual media and print media is so clear. The Supreme Court on Wednesday directed the CBI to file a status report on the investigation into intercepted conversations of corporate lobbyist Niira Radia. A three-judge bench headed by Justice D Y Chandrachud was hearing a plea filed by industrialist Ratan Tata seeking protection of right to privacy in view of the emergence of the Radia tapes. "We will have it after the vacations as there is a Constitution Bench next week. Meanwhile, the CBI may file an updated status report," said the bench also comprising Justices Hima Kohli and P S Narasimha. The matter is posted for next hearing on October 12. Voicing displeasure over hate speech on TV news channels, the Supreme Court Wednesday wanted it know why the government was a "mute spectator" and whether it intends to enact a law to curb it, as recommended by the Law Commission. Noting that the role of the anchor is important during TV debates, the court said it's the duty of the anchor to prevent hate speeches from happening. SC upholds constitutional validity of Haryana Sikh Gurdwara Management Act

The Supreme Court on Tuesday upheld the constitutional validity of the Haryana Sikh Gurdwara (Management) Act, 2014 under which a separate committee was formed to manage the affairs of gurdwaras in the state. A bench of Justices Hemant Gupta and Vikram Nath dismissed the plea filed by a member of the Shiromani Gurdwara Prabandhak Committee seeking quashing of the Haryana Sikh Gurdwara Act. SC issues notice to Centre on plea alleging shortage of anti-HIV drugs

The Supreme Court has sought response from the Centre and others on a plea alleging shortage of antiretroviral drugs for treating HIV patients in the country. A bench of Justices D Y Chandrachud and Hima Kohli issued notice to the Ministry of Health, National AIDS Control Organisation and others on a plea filed by an NGO. "The petitioners have submitted that there are shortages in the procurement of ART drugs in the country and the tender for 2021-22, which was due in August 2021, was issued in December 2021 and eventually failed. Issue notice, returnable in two weeks," the bench said. Antiretroviral therapy (ART) is treatment of people infected with human immunodeficiency virus (HIV) using anti-HIV drugs. Bihar Cricket Association cannot make amendments to its constitution: SC

The Supreme Court on Monday said the Bihar Cricket Association cannot amend its own constitution and directed it to file an affidavit explaining the mechanism it is following for its elections scheduled on September 25. A bench of justices D Y Chandrachud and Hima Kohli asked the cricket body to clarify if it has changed the constitution of electoral college for the purpose of elections. "You can certainly hold the election, but you cannot amend the constitution. You file a short affidavit explaining what steps you are taking. We will record your undertaking in those terms that you will not give effect to amendment for elections," the bench observed. The top court said it would hear the matter on Friday. SC refers to 5-judge bench on 'mitigating circumstances' in Death Penalty

The Supreme Court on Monday referred to a five-judge Constitution bench a suo motu plea on framing of guidelines on how and when potential mitigating circumstances be considered by courts during trial in cases which entail the death penalty as the maximum punishment. A bench headed by Chief Justice Uday Umesh Lalit said it was of the opinion that this matter required a hearing by a larger bench to have clarity and uniform approach as to when an accused, facing death penalty as maximum sentence, is required to be heard with regard to mitigating circumstances. Let matter be placed before the CJI for orders in this regard, Justice S Ravindra Bhat said while pronouncing the verdict. SC trashes 13,147 old cases in one stroke to unclog justice delivery system

In a big step towards unclogging the top judiciary burdened with humongous pendency of cases, the Supreme Court has, in one massive sweep, binned 13,147 old "diarized but unregistered" cases, including one filed more than three decades ago. An order issued by Registrar Judicial-1 Chirag Bhanu Singh on Thursday said all these cases were filed more than eight years ago but the defects pointed out by the Registry to the respective counsel or petitioners in-person were not "cured". The cases got the diary numbers prior to the year 2014, and the list included a case filed way back in 1987. These petitions just sat idly in the Registry, adding to the ever growing pendency. As per the data uploaded on the Supreme Court website, there were as many as 70,310 pendig cases as on September 1, 2022. A day before Prime Minister Narendra Modi releases eight cheetahs brought from Namibia in a Madhya Pradesh national park, the Congress said Friday the proposal for 'Project Cheetah' was prepared in 2008-09 and approved by the then Manmohan Singh-led UPA government. The opposition party also said that in 2013, the Supreme Court had stayed the project, and in 2020, that the apex court allowed it, paving the way for the cheetahs to come ot India. "The proposal for 'Project Cheetah' was prepared in 2008-09. Manmohan Singh's government gave approval to it. The then Forest and Environment Minister, Jairam Ramesh, went to Cheetah outreach centre in South Africa in April 2010," the Congress said in a tweet.
