SC to hear on Friday NIA's appeal against activist Anand Teltumbde bail

The Supreme Court agreed to hear on Friday an appeal by the National Investigation Agency against the bail granted to scholar-activist Anand Teltumbde in the Elgar Parishad-Maoist links case. A bench, headed by Chief Justice of India D Y Chandrachud, took note of the submissions by Solicitor General Tushar Mehta that the stay on the operation on the high court's bail order is for a week only and the matter needed urgent hearing. "We will hear it on Friday," the CJI told the law officer. The Bombay High Court had granted bail to Teltumbde last Friday in the Elgar Parishad-Maoist links case, noting that there was no evidence to show that he was an active member of the banned outfit CPI (Maoist) or had indulged in any terrorist act. Teltumbde, 73, is the third accused of the total 16 arrested in the case to be released on bail. Poet Varavara Rao is currently out on bail on health grounds, and lawyer Sudha Bharadwaj is out on regular bail. The high court, however, had stayed its bail

Mumbai court orders release of activist Gautam Navlakha from house arrest

Gautam Navlakha, an accused in Elgar Parishad-Maoist links case, is likely to walk out of the Taloja prison in Navi Mumbai on Saturday, as a special court here issued a release memo to facilitate his month-long house arrest. The special court hearing cases related to the National Investigation Agency (NIA) issued the release memo around 2.15 pm on Saturday. On Friday afternoon, the Supreme Court had rejected the NIA's application and ordered that Navlakha be placed under house arrest "without fail" within 24 hours. The investigating agency on Saturday submitted to the special court here the compliance report about completing the release formalities of the activist, after which the court issued the release memo, which will then be mailed to the jail authorities and the Navi Mumbai police commissioner. Social media platforms being used to raise funds for terror activities: NIA

India has evidence social media platforms are being used to raise terror funds, NIA Director General Dinkar Gupta said Thursday, underlining that the issue will be deliberated during a two-day international ministerial conference on countering terror financing. Addressing a press conference ahead of the meeting beginning Friday, Gupta also said Pakistan and Afghanistan were not participating in the conference, while China was yet to confirm. Union minister Raosaheb Danve on Tuesday met the family members of Bajrang Dal activist Kamaldev Giri, who was killed in bomb attack last week, and assured them that he would try to facilitate a probe by a central investigative agency in the case. The minister, who was on a visit to the district, also said that the administration must take necessary measures to ensure that perpetrators are punished. Giri's family members and supporters, during the meeting, submitted a memorandum to the Union minister of state for railways, seeking justice for him and also claiming that a conspiracy was hatched to murder him. The memorandum also stated that the Bajrang Dal activist had pleaded with the district administration for security but in vain. The National Investigation Agency (NIA) on Monday told a special court here that two witnesses in the September 2008 Malegaon blast case who were to depose during the day have died. Special public prosecutor Avinash Rasal informed the special NIA court both succumbed to natural causes and submitted their death certificates. One of the witnesses had, in his statement to the earlier investigating agency Maharashtra's Anti Terrorism Squad (ATS), claimed he met accused Colonel Prasad Purohit and other accused in the case on several occasions during which they had spoken about their right wing group Abhinav Bharat and RSS chief Mohan Bhagwat and Indresh Kumar. So far 27 witnesses have turned hostile in the case in which BJP MP Sadhvi Pragya Singh and Purohit are accused. The National Investigation Agency (NIA) has registered an FIR in the October 8-9 clashes between two communities in Ekbalpur area of Kolkata, a senior official said. The anti-terror agency is likely to start an investigation into the clashes from Wednesday and its officers may submit a copy of the complaint at Bankshall Court in the city, he said. The NIA has taken over the investigation and registered the FIR on Tuesday. "We are going to seek the custody of those arrested by Kolkata Police. We may seek video footage of the CCTV from the area. The Supreme Court on Friday refused to stay the Bombay High Court order acquitting Delhi University Professor G N Saibaba in a case relating to his alleged Maoist links. Hours after the Bombay High Court order, the National Investigation Agency (NIA) moved the Supreme Court for stay which was declined. The apex court, however, allowed the NIA to move an application before the registry requesting for urgent listing. A bench of Justices DY Chandrachud and Hima Kohli told Solicitor General Tushar Mehta, who mentioned the matter for urgent listing and stay of the verdict, that the court cannot stay the acquittal order as the parties are not before it. Arrested PFI leaders in Kerala sent to judicial custody till Oct 20

A special court here on Friday sent 11 Popular Front of India (PFI) activists, who were arrested by the National Investigation Agency (NIA) recently, to judicial custody till October 20. The accused were produced before the court as their NIA custody period ended today. The court has asked the NIA to produce the accused on October 20. Rajasthan empowers police to act against banned PFI, similar organisations

The Rajasthan home department on Thursday released an order empowering the state police to act against the Popular Front of India (PFI) and other similar organisations. The order was released following the Centre's notification banning the PFI and affiliates for five years. The department has ordered the Director-General of Police, Additional Director-General of Police (Anti-Terror Squad and Special Operations Group), commissioners of Jaipur and Jodhpur, Inspector General range and Superintendents of Police and district courts to act against these organisations under sections of the Unlawful Activities Prevention Act (UAPA). In a notification issued late on Tuesday night, the Union Home Ministry said the central government is of the opinion that the PFI and its affiliates have been involved in subversive activities, thereby disturbing public order and undermining constitutional set up of the country and encouraging and enforcing a terror-based regressive regime.

Fresh crackdown against PFI: More than 170 held across seven states

More than 170 people allegedly linked with the Popular Front of India (PFI) were detained or arrested in raids across seven states on Tuesday, five days after a similar pan India crackdown against the group often accused of being linked to radical Islam. Conducted mostly by state police teams, the raids were spread across Uttar Pradesh, Karnataka, Gujarat, Delhi, Maharashtra, Assam and Madhya Pradesh. Twenty-five Popular Front of India (PFI) activists were arrested from different districts of Assam in a fresh crackdown against the outfit on Tuesday, police said. The highest number of 10 PFI activists were held in Goalpara, five in Kamrup (Rural) and three in Dhubri, followed by arrests in Barpeta, Baksa, Darrang, Udalguri and Karimganj, they said. Earlier, 11 people were arrested by the Assam Police from various parts of the state and Delhi, after a nation-wide clampdown against the organisation since September 22. Chief Minister Himanta Biswa Sarma had earlier said that his government has been urging the Centre to ban the outfit for allegedly creating an eco-system for terror activities.
