Plea in SC against automatic disqualification upon conviction for 2 years

A plea has been filed in the Supreme Court challenging the "automatic disqualification" of lawmakers upon their conviction and being sentenced to a jail term for two years or more according to section 8(3) of the Representation of the People Act. The plea, filed by a Kerala-based social activist, said the immediate reason for approaching the apex court was a recent development related to Congress leader Rahul Gandhi's disqualification as a member of Parliament from the Wayanad Lok Sabha constituency, after he was convicted by a court in Gujarat's Surat in a 2019 criminal defamation case. The petitioner, Aabha Muralidharan, has sought a declaration that the automatic disqualification under section 8(3) of the Representation of the People Act, 1951 is ultra vires the Constitution for being "arbitrary" and "illegal". Lok Sabha approves setting up of GST Appellate Tribunal to solve disputes

Lok Sabha on Friday cleared changes in the Finance Bill to pave the way for setting up of an appellate tribunal for resolution of disputes under GST. Currently, taxpayers are filing writ petitions before high courts in the absence of the appellate tribunal. As per the amendments proposed in the Finance Bill 2023, which was passed by Lok Sabha on Friday, benches of the GST Appellate Tribunal would be set up in every state while there will be a principal bench in Delhi which will hear appeals related to 'place of supply'. Even after more than five years of implementation of the Goods and Services Tax (GST), the appellate tribunal has not been set up. As a result, unresolved legal matters under GST have accumulated. Lok Sabha passes Finance Bill with 64 official amendments with discussion

Lok Sabha on Friday passed the Finance Bill 2023 with 64 official amendments, including the one that seeks withdrawal of long-term tax benefits on certain categories of debt mutual funds and another for setting up the GST Appelate Tribunal. The Finance Bill that gives effect to tax proposals for fiscal year starting April 1 was passed without a discussion amidst ruckus by opposition members demanding a JPC (Joint Parliamentary Committee) probe into the allegations against the Adani group of companies. Lok Sabha passes Rs 45 trillion Budget for current fiscal without debate

Lok Sabha on Thursday approved the Union Budget envisaging an expenditure of around Rs 45 lakh crore for the fiscal year starting April 1 without any discussion, as the Opposition continued to create ruckus over demand for a JPC probe into allegations against the Adani Group. The Lower House of Parliament took up the Demands for Grants and Appropriation Bills after two adjournments as the ruling and Opposition MPs engaged in a matching duet over demands for an apology by Rahul Gandhi and the Adani issue. Most of the second leg of the Budget Session has been washed out due to the protest by both sides and it was one of the rare occasions when the Budget was passed without any discussion. Lok Sabha passes Rs 1.48 trillion supplementary grants without debate

Lok Sabha on Tuesday gave its approval to the central government to spend an additional Rs 1.48 lakh crore during the current financial year 2022-23, amid uproar by Opposition parties on the Adani issue. On March 13, Minister of State for Finance Pankaj Chaudhary had tabled the second batch of supplementary demands for grants in the House amounting to a total of Rs 2,70,508.89 crore. "However, the net cash outgo aggregate is estimated at only Rs 1,48,133.23 crore. The remaining expenditure will be matched by savings of the Ministries/Departments or by enhanced receipts/recoveries aggregates to Rs 1,22,374.37 crore," said the statement on supplementary demands for grants. Of the total additional cash outgo, Rs 36,325 crore is for payment towards fertiliser subsidy. This includes additional subsidy outgo of Rs 21,000 crore for P&K (phosphorus and potassium) and Rs 15,325.36 crore for urea. 427,000 undertrial prisoners in country as on Dec 31, 2021: Govt in LS

As many as 4.27 lakh undertrial prisoners were lodged in jails across the country as on December 31, 2021, Lok Sabha was informed on Tuesday. Union Minister of State for Home Ajay Kumar Mishra said the number of undertrial prisoners has increased over the years from 2,82,879 on December 31, 2014 to 4,27,167 on December 31, 2021. He said there were 90,037 Scheduled Caste undertrial prisoners as on December 31, 2021, 42,211 undertrial prisoners belonging to Scheduled Tribes and 1,51,287 were from Other Backward Classes.
