Ethical hacking with permission of owner does not attract liability: MoS IT

Ethical hacking of computer systems or networks done with the permission of its owner does not attract any liability under the IT Act, Parliament was informed on Friday. The Minister of State for Electronics and Information Technology in response to a question on the guidelines for ethical hacking shared that liability for compensation and punishment under provisions of the IT Act arises if anyone gains access to a computer system without the permission of its owner. "Any act, including an act of ethical hacking, undertaken with the permission/ consent of its owner does not attract liability under the said or other provisions of the Act," Chandrasekhar said. Amendment of guidelines aimed at protection of online users: IT minister

IT Minister Ashwini Vaishnaw on Friday said the latest amendment of intermediary guidelines is focused on protection of online users. The comment came as the government notified new rules under which it will set up appellate panels to settle grievances that users may have against decisions of social media platforms like Twitter and Facebook on hosting contentious content. The three-member Grievance Appellate Committee(s) will be set in three months, according to the gazette notification issued on Friday. Soon after the tweaks in IT rules were notified, Vaishnaw said, The focus of the amendment of intermediary guidelines is on the protection of online users. The law of the land is supreme. Intermediary to ensure accessibility of its services to all users and respect their rights under the Constitution of India," he noted.
