There cannot be any "cut-and-dried formula" or "theorem" that gives an answer whether a Constitution amendment violates the basic structure, Supreme Court judge Justice Dinesh Maheswari said while upholding the EWS quota. The top court in a 3:2 majority decision upheld the 10 per cent reservation for economically weaker sections (EWS) in admissions and government jobs that excluded the poor among the Scheduled Castes (SC), Scheduled Tribes (ST) and Other Backward Classes (OBCs) categories. Justice Maheswari, who along with justices Bela M Trivedi and J B Pardiwala upheld the 103rd Constitution amendment, said, "It is beyond doubt that using the doctrine of basic structure as a sword against the amendment in question and thereby to stultify the State's effort to do economic justice as ordained by the Preamble and DPSP and, inter alia, enshrined in Articles 38, 39 and 46, cannot be countenanced." The Supreme Court is scheduled to pronounce on Monday its judgement on a batch of pleas challenging the validity of the 103rd Constitution amendment providing 10 per cent reservation to economically weaker sections (EWS) persons in admissions and government jobs. According to the causelist of November 7 uploaded on the apex court website, a five-judge Constitution bench headed by Chief Justice Uday Umesh Lalit would deliver the verdict in the matter. The apex court had on September 27 reserved the verdict on the legal question of whether the EWS quota violated the basic structure of the Constitution after hearing a battery of senior lawyers, including the then Attorney General K K Venugopal and Solicitor General Tushar Mehta, in the marathon hearing that had lasted for six-and-half-day. PM to inaugurate over 3,000 EWS flats at Bhoomihin camp in Delhi tomorrow

Prime Minister Narendra Modi will inaugurate 3,024 newly constructed Economically Weaker Section flats in Delhi as part of an in-situ slum rehabilitation project on Wednesday evening, his office has said. During the programme at Vigyan Bhawan here, the slum dwellers at Bhoomihin camp will also be handed over keys to the flats, thereby giving them the ownership and a sense of security, a PMO statement said. The in-situ slum rehabilitation in 376 Jhuggi Jhopri clusters is being undertaken by the Delhi Development Authority (DDA) in line with the prime minister's vision to provide housing for all, it said. "The objective of the rehabilitation project is to provide a better and healthy living environment to the residents of Jhuggi Jhopri clusters, with proper amenities and facilities," the statement added.
