Stamp duty on media advertisements: SC stays Bombay HC order

The Supreme Court employed a stay on the BombayHigh Court verdict that allowed the levy of stamp duty by the Maharashtragovernment on advertisements in print and electronic media, calling it adebatable issue. It also directed thateach of the members of the petitioner Indian Broadcasting Foundation shall givea summary of revenue earned through advertisement. The bench that included Justices DipakMisra and A M Khanwilkar said, "We are of the considered opinion that thematter requires to be debated, especially keeping in view the sacrosanctity offreedom of speech and expression and involvement of electronic and printmedia... "Therefore, we direct that there shallbe a stay of the operation of the judgement of the high court, subject to themember of the petitioner-foundation keeping accounts with itself and giving atleast samples of ten agreements to the respondent state so that eventually atthe time of final adjudication appropriate relief can be moulded," itsaid.
